Web Hosting

	Adult Sites/Unacceptable Content - Pornography and pornographic related merchandising are prohibited under all eeHosting.com services. This includes sites that include links to pornographic content elsewhere. Further examples of unacceptable content or links include pirated software, “hacker” programs, archives of “Warez Sites”, game rooms or MUDs, IRC Bots, Egg Drop programs, any kind of illegal software or shareware. In addition sites offering online gambling, casino functionality, sports book betting (including offshore), and Internet lotteries are prohibited.
	Copyright Violation - Engaging in activity that infringes or misappropriates the Intellectual Property rights of third parties, including copyrights, trademarks, service marks, trade secrets, software piracy and patents and other similar rights held by third parties shall result in termination of all "subscribers" privileges on the "eeHosting.com" system.
	How to claim a copyright infringement: Pursuant to 17 U.S.C. 512(c) (2), all notifications of claimed copyright infringement on the "eeHosting.com" system or Web sites should be sent to our Network Administrator at copyright@eeHosting.com and shall include the following information:
		A physical or electronic signature of the copyright owner or a person authorized to act on the copyright owner's behalf.
		Identification of the copyrighted work(s) claimed to have been infringed.
		Identification of the material claimed to infringe the copyright(s), reasonably sufficient to enable "eeHosting.com" to locate the material in order to remove the material or disable access.
		Information reasonably sufficient to allow "eeHosting.com" to contact the complaining party (including name, address, phone number, and e-mail address)
		Statement that the complaining Claimant has a "good faith belief that use of the material in the manner complained of is not authorized by the copyright [holder], its agent or the law."
		Statement that the information in the notice is accurate, and under PENALTY OF PERJURY, that the complaining party is authorized to act on behalf of the copyright owner.

	Customer Support - eeHosting.com promotes a mutually professional relationship with its customers. Obscene, abusive, threatening or otherwise harassing communications with agents of the Company, via telephone, email, online chat, ticket system or other means will result in immediate account termination not withstanding any other terms of this agreement. Violation of this will result in refund ineligibility.
	Distribution and/or Transmission of Obscene or Indecent Speech or Materials -- Violation of indecency and obscenity laws can result in criminal penalties.
	Distribution of Internet Viruses, Worms, Trojan Horses and Other Destructive Activities -- Distribution of Internet viruses, worms, Trojan horses and other destructive activities, such as hacking, can result in serious civil and or criminal liability under federal and state law.
	Illegal/Unauthorized Access to Other Computers or Networks -- The illegal or unauthorized accessing (often known as "hacking") of computers or networks carries potential civil and criminal penalties under both federal laws and the laws of most states.
	Image Repository -- The WHP services are not to be used as a software/image repository. This means you cannot use your account to store images that are pulled from another website. An example of this would be storing images to be pulled from an eBay auction site.
	Software/Script Support – Customer acknowledges that eeHosting.com cannot provide technical support for any software and/or script that the Customer installs, other than variable name changes. Customer also acknowledges that eeHosting.com does not supply technical support for Microsoft FrontPage, other than initial configuration. eeHosting.com supplies technical support for web hosting issues only. eeHosting.com shall be the sole arbiter as to what constitutes a “webhosting” issue.
	Spamming -- Unsolicited, commercial Email (UCE) is strongly disfavored practice among Internet users and web hosting providers. Violation of this or any section of this Agreement will result in immediate account suspension and/or termination or penalties and refund ineligibility. For details see below:
		Sending UCE referencing a domain or web site hosted by the Company
		Sending UCE referencing an IP address hosted by the Company
		Posting advertisements on IRC, ICQ, or any other public chat system
		containing an email address hosted by the Company
		Use of unsolicited email originating from networks of other Internet
		Service Providers on behalf of, or to advertise, any service hosted by the Company
	Other activities, whether lawful or unlawful, that we determine to be harmful to our customers, operations or reputation, including any activities that restrict or inhibit any other user from using and enjoying the service or the Internet. Any violations of this agreement will result in refund ineligibility.

As we have pointed out, the responsibility for avoiding the harmful activities just described rests primarily with the customer. We will not, as an ordinary practice, monitor the communications of our customers to ensure that they comply with our policy or applicable law. When we become aware of harmful communications, however, we may take any of a variety of actions. We may remove information that violates our policies, implement screening software designed to block offending transmissions, or take any other action we deem appropriate, including termination of a customer's contract with us.

We are not responsible for loss of customer content due to server or hardware failure. We do, however, backup our systems weekly, but cannot guarantee the content is up-to-date. It is the customer's responsibility to have a full backup of their site.
 

Links to Other Sites
 
Links to Other Sites may appear from time to time on the HoxPlus FZE Site. These links have been established to offer additional resources on subjects you find of interest on the HoxPlus FZE Site. In some instances, such links are a result of cooperative projects with organizations that own, operate or maintain the Other Sites.

HoxPlus FZE has no control over content that appears on Other Sites. Such content is subject to change and/or elimination. HoxPlus FZE assumes no responsibility for content, including factual errors and continuing availability, appearing on Other Sites.

Export Controls
You agree that your use of the HoxPlus FZE Site will comply with all applicable laws, rules and regulations that govern the export of technical data.

Choice Of Law, Jurisdiction and Venue
 
This HoxPlus FZE Site is operated from our offices in UAE. This Agreement shall be governed by and construed in accordance with the laws of UAE, without reference to any conflict of law principles. You agree that any action at law or in equity arising out of or relating to these terms and conditions shall be filed only in the courts located in UAE. You further consent and submit to the personal jurisdiction of these courts for the purposes of litigating any such action.

Compliance with Laws
 
HoxPlus FZE endeavours to ensure that the HoxPlus FZE Site complies with the requirements of UAE laws as well as the foreign laws of any country where it is intended for the HoxPlus FZE Site to be viewed. In the event that a foreign country's law may not be fully satisfied, then HoxPlus FZE shall be deemed not to be directing the HoxPlus FZE Site to that particular country. (The sanctioned countries are Iran, Sudan, North Korea etc.)

You will be charged in AED currency, conversion rate would be decided by the corresponding banks or Card issuers.

Indemnification
 
You hereby indemnify, defend, and hold us and our affiliates and our officers, directors, employees, agents and representatives (collectively, the "Indemnified Parties") harmless from and against any and all liabilities and costs (including reasonable attorneys' fees') incurred by the Indemnified Parties in connection with any claim arising out of any breach by you of this Agreement. You shall use your best efforts to cooperate with us in the defence of any claim. We reserve the right, at our own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you.
 

Limitation of Liability
 
UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL WE BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF, OR THE INABILITY TO USE, THE HoxPlus FZE SITE OR MATERIALS OR FUNCTIONS ON THE HoxPlus FZE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN THE EVENT APPLICABLE LAW DOES NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY OR INCIDENTAL OR CONSEQUENTIAL DAMAGES, OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT [INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE], OR OTHERWISE) WILL NOT EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE HoxPlus FZE SITE.
 

Limitation of Claims
The user must bring any action on any claim against HoxPlus FZE within one (1) year following the date the claim first accrued, or it shall be deemed waived.

General Provisions
 
If any of these terms and conditions shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these terms and conditions and shall not affect the validity and enforceability of any remaining provisions. This is the entire agreement between the parties and may not be modified except in writing signed by both parties.

In such cases, the terms and conditions of use of the particular HoxPlus FZE company will be posted and will supersede the provisions of this document in the event of a conflict.
